“Not – for – profit”
By Richard Waldroff
Many hockey operations, semi-pro, junior and minor have charters or an Ontario incorporation identity as a “not
for profit” organization. For the longest time now this identity has been very much a hands-off business label,
with very limited reporting requirements and with adequate protection for persons in leadership positions.
As it seems it is for all things which seem to be doing fine, someone in the Ontario Provincial government felt
it was time for change/review. New legislation was introduced, received the necessary legislative support and
now sits before committee, who are reviewing a number of amendments to the document. This new legislation is
expected to go into practice sometime in the next couple of years.
Conformity will be a requirement within a set timetable after the legislation is enacted provided you wish to
maintain your “not for profit” identity. I don’t know what other options there may be, but it seems like this one
has worked best for us to date. The changes are not insurmountable; Hockey Eastern Ontario, the mother ship
for hockey in eastern Ontario has engaged an organization to lead them through the process. This process will
be well documented and made available to the “member partners: junior hockey teams, leagues, districts and
associations.
If your group has a “Not for profit” identity you need to think about preparing to meet the legislative changes
coming, these changes affect all groups with this identity not just hockey.
On another note, happy 25th Anniversary to the Seaway Valley “AA” association. It was nice to see some of the
many founding and past committee present at the Benson Centre honouring the occasion.
Keep your stick below the waist!
